TERMS AND CONDITIONS

WHEREAS SprinCakes & Co is a sole proprietorship owned by Sheenah Labay-Jimenez and may be referred to as "SprinCakes & Co," "we," "us," “my,” “I,” or "our." Cake made to order

AND WHEREAS these terms of service ("Terms," “Terms and Conditions,” “Terms & Conditions,” or "agreement") are incorporated by reference into all SprinCakes & Co clients ("Client," "you" or "your") proposals and quotes ("Client Proposal" or “Client Quote”).

AND WHEREAS these Terms apply and form part of the agreement between SprinCakes & Co and the Client upon the Client's acceptance of the Client Proposal and/or upon Agreement to Terms.

For these Terms, "Parties" means SprinCakes & Co and the Client and "Party" means either.  In consideration of the mutual promises and agreements set out below, the Parties agree as follows:

Privacy

We collect and use personal information under our privacy policy (which is incorporated by reference and available online at https://Sprincakesco.ca/privacy/).  By using our Website and Service, you consent to such processing and warrant that all information you provide is accurate.

Products and Services

SprinCakes & Co. creates custom-made cakes for a variety of occasions.  You can learn about our most current products and services at https://Sprincakesco.ca.

All products are subjected to the terms and conditions listed below.

Pricing

Custom Cakes

Custom-made cake prices are provided on a quote-by-quote basis and are subject to a few factors.  SprinCakes & Co. will provide a quote for your custom cake by phone, email, or social media.

Standard Cakes

Cakes By Haneesh also offers some standard products for which there are standard prices.  For current pricing, please visit https://Sprincakesco.ca. 

Taxes

You agree to pay all sales taxes, whether Canadian or foreign, applicable to this agreement or arising, in any way, from purchases made from us.

Cake Ordering

Definitions

The reservation date refers to the date you will receive your cake.  Depending on our arrangement, you will receive your cake by pick-up or delivery.

A confirmed order refers to your order being officially booked with SprinCakes & Co. When an order has been confirmed, the reservation date has been blocked off for you. SprinCakes & Co will purchase the materials necessary to produce your cake and begin creating the cake on an appropriate timeline. A confirmed order means a downpayment has been received according to the product type you ordered. 

For our package service, we require a $100 refundable deposit. This deposit covers any damage after using tables, backdrops, linens, skirting, cake stands, cupcake stands, cake pop stands, and other decorative furniture. And these Terms have been agreed to. 

Order Confirmation

Standard Products & Cakes

Your standard product and cake order will be confirmed when the Downpayment is received and you have agreed to our Terms. If a downpayment is not accepted and terms are not agreed to, your order will not be considered confirmed.

Custom Products & Cakes

Your custom product and cake order will be confirmed when adown payment is received and you agree to our Terms. If this partial payment is not received and the terms are not agreed upon, your order will not be considered confirmed.

Full Payment is required 15 business days (2 weeks) before the reservation date. 

Unconfirmed Orders

If the order is not confirmed, your reservation date will not be blocked off and could be taken by another client.  SprinCakes & Co. will not make your product or reserve your date until the order is confirmed.

Changes To Orders

Before 14 business days (2 weeks) of the reservation date

Any changes to the initial order before seven days of the reservation date (see definition under Cake Ordering) will be subject to a fee of at least $20.00.  Fees could be higher depending on the extent of the changes that you would like to make.

14 business days or less (less than two weeks) before the reservation date

No changes to the order within seven days before the reservation date will be accepted.

Cancellation / Refunds

Custom Cakes

Before 14 business days (2 weeks) of the reservation date

If the order is cancelled 15 business days before the reservation date, the initial 50% deposit is refundable.

14 business days or less (less than two weeks) before the reservation date

The initial 50% deposit becomes NON-REFUNDABLE and NON-TRANSFERABLE within 15 days of the reservation date (15 business days or less before the reservation date).

If the order is cancelled within seven days before the reservation date, the total cost of the cake is NON-REFUNDABLE/ NON-TRANSFERABLE. This includes all expenses incurred.

Standard Cakes

All standard cakes are non-refundable/non-transferable. 

Consumed or Handled Products

No refunds can be issued on products consumed or handled by the Client, and no refunds can be issued after the product has been transferred.

Designs

Photograph Examples

The photographs sent are used for inspiration only. Cakes By Haneesh respects the hard work of the original cake designer; thus, the product design cannot be the same.

Cake Specifications

SprinCakes & Co. will do its best to meet the specifications outlined in the contract. Please understand that your cake design outcome may vary and will be subject to personal ideas and designs in addition to what you specify.

Fresh Flowers

Suppose the Client chooses to have fresh flowers applied to the cake by an outside florist. In that case, it is the sole responsibility of the customer and their hired florist to determine flower safety and safe food practices, not SprinCakes & Co.

Edible Food Colours

Edible food colours are very volatile. Hues may vary and cannot be guaranteed at the time of the event.

Safety Considerations

Sugar Flowers (Safety)

Sugar Flowers contain wires, bamboo sticks, and other non-edible materials. They are not recommended for consumption and are for decorative purposes only.

Tiered Cakes (Safety)

Tiered cakes contain wooden dowels or straws for added support and must be removed before serving. Smashing the cake on the face or hands is also not recommended for fun, as it may contain dowels that can cause unintentional injury. 

Allergens

*SprinCakes & Co is not a nut-free establishment that is not subject to inspection as per AHS under low-risk home food preparation. Cake ingredients or equipment may have come in contact with nuts, milk, artificial colors and/or wheat products. SprinCakes & Co does not assume liability for any adverse reaction to items provided to the customer/customer's event.

DELIVERY /PICK UP 

Delivery Pricing

SprinCakes & Co. offers a fee-for-delivery service.  Fees will be discussed before confirming your order and included in your quote.  General delivery fees can be found at https://Sprincakesco.ca, but costs are subject to change depending on the Client's location and time of day, among other factors.

Damage During Handling & Transport

All orders are the Client's responsibility once they are transferred safely to pick-up or delivery time. SprinCakes & Co. is not responsible for any damage occurring during transport, set up, or handling anytime after the product has been transferred to the Client. Product handling suggestions can be provided upon order confirmation or before pick-up/delivery.

Problems with Delivery

In the case of an unavoidable situation, such as a car accident or poor road conditions during delivery, SprinCakes & Co. cannot be held liable for more than the cost of the ordered product. A store credit can be issued at the discretion of the designer.

Driving Directions & Hazards

Where applicable, the Customer shall provide clear driving directions to the desired delivery location and inform SprinCakes & Co. of any adverse road hazards or obstacles that may damage the finished cake.
